Chapter 1
The referee
Who chooses the Election Commission, what changed in 2023, and how are its decisions taken?
From 1950, Article 324(2) left the appointment of Election Commissioners to the President, "subject to the provisions of any law made in that behalf by Parliament", and in practice the President acted on the Prime Minister's advice. A 1990 committee and a 2015 Law Commission report proposed consulting the Leader of the Opposition and the Chief Justice, and in March 2023 the Supreme Court recorded that no such law had been enacted. For how many years did that article wait for a law?

In May 2025 the Commission announced ECINet, one platform to absorb over 40 of its apps, among them ERONET, the system Electoral Registration Officers use for roll applications, and the BLO App. It said data would be "entered solely by the authorized ECI official" and that statutory forms would prevail in any conflict. Goa's final roll on 21 February 2026 left out 97 electors whom its Electoral Registration Officers had found eligible after hearings ordered by the Supreme Court. Calcutta HC admits Mamata Banerjee's Bhabanipur poll petition, orders EVMs, CCTV preserved
A four-member Kolkata Police Special Investigation Team began work on 12 June; on 1 October, with officials saying the cause had not been established, Trinamool's Abhishek Banerjee said "nobody has been held accountable" and sought counting-centre CCTV from nearly 100 constituencies, and no reply from the Commission was reported. Under the 45-day rule, was counting-centre footage still held on 1 October for any of the nearly 100 constituencies other than those under an election petition?

Rates and expected deaths are computed here from the two cited figures. A crude death rate covers all ages; adult rates run higher, so the years shown are an upper bound.
